What Is Inspection Pass
An inspection pass occurs when a rental unit successfully meets all Housing Quality Standards (HQS) requirements during a physical inspection by a Public Housing Authority (PHA) or NSPIRE-certified inspector. Once a unit passes, the landlord receives written approval from the PHA, allowing the unit to be leased to a Section 8 voucher holder and begin receiving Housing Assistance Payments (HAP).
The Inspection Process
The NSPIRE inspection protocol evaluates 40+ HQS items across eight major categories: sanitation, safety, thermal environment, structure and materials, non-life-threatening defects, access and illumination, and neighborhood characteristics. An inspector conducts a walk-through of the unit and surrounding property, checking everything from water pressure and heating systems to carbon monoxide detectors, electrical outlets, and roof condition.
For an inspection to result in a pass, the unit must have zero life-threatening violations. Minor deficiencies can sometimes be addressed with a reinspection scheduled within 30 days. Life-threatening defects, such as missing smoke detectors, exposed wiring, or lack of hot water, result in an automatic failure and block lease execution until corrections are made.
What Happens After a Pass
- HAP contract activation: The landlord can execute a Housing Assistance Payment contract with the PHA, establishing the rent payment schedule and tenant protections.
- Lease execution: The tenant and landlord can sign a lease agreement. The voucher holder pays their portion of rent (typically 30% of income), and the PHA pays the difference directly to the landlord.
- Annual recertification:
- Rent reasonableness review: Even after passing inspection, the PHA may conduct a rent reasonableness determination to ensure the lease amount does not exceed Fair Market Rent (FMR) for the area.
Common Questions
How long does an inspection pass remain valid? A pass is valid for the duration of the lease term, but landlords must maintain HQS compliance year-round. Tenants or PHAs can request interim inspections if conditions deteriorate or complaints arise. Annual inspections are standard at recertification.
What if minor repairs are needed before I can pass? The inspector will note deficiencies on the inspection form. If they are non-life-threatening, you typically have 30 days to correct them and request a reinspection. Life-threatening items must be fixed before the inspection can be marked as passed.
Can a tenant move in during the reinspection period? No. The lease cannot be executed and HAP cannot begin until the unit officially passes inspection. This is a federal requirement.
